McMullen Oils Ltd does not accept responsibility for the dipping or testing of the buyer’s tanks. It is the buyer’s obligation to ensure that the truck operator connects correctly to the feed on the buyer’s tank.
The buyer shall be responsible for ensuring that the storage into which the delivery is made will accommodate the full quantity ordered.
The seller’s measure of quantity shall be accepted by the buyer, except in cases of manifest error, with the seller’s reading being conclusive and binding. The seller cannot accept any responsibility for discrepancies in the buyer's tanks, dip rod, or other measuring device. It is a condition of every bulk sale that the quantity shown by the terminal meter ticket or other measuring device employed shall, for the purpose of accounts, be accepted by the buyer as the quantity delivered. The buyer may verify the measurements if desired.
In the event of missing contingents, short delivery, or damage, the seller shall only investigate if notified in writing within three days of the date of dispatch.
The price to be paid for any order shall be the price ruling at the date of delivery, and for deliveries made in more than one consignment, the price for each consignment will reflect the price ruling on the date such consignments are delivered. This price will reflect any tax, duty, or other impositions (other than VAT), which will be charged separately.
Notice of any claims for damage, defect, variance in quality or description, or shortage in quantity must be given in writing to the seller at their registered address shown on the invoice, no later than three days after the products are delivered, or in the case of non-delivery, within three days of the invoice receipt.
Subject to the above, the seller undertakes to replace any product which differs in quality or description from what was invoiced at no additional cost. All other warranties and conditions, expressed or implied, are excluded, and the seller shall not be liable for any injury, loss, or damage resulting from the sale or delivery of the products.
Payment for supplies will be by cash on delivery or according to terms established periodically by the seller. Interest will be charged at the current bank rate on overdue amounts.
The seller shall not be responsible for any failure to make deliveries if fulfillment has been delayed, hindered, or prevented by circumstances beyond the seller’s immediate control.
All deliveries at the buyer’s premises or into the buyer’s vehicles are at the buyer’s sole risk.
Risk in the product(s) passes to the buyer upon delivery, but ownership remains with the seller until all dues, including interest, are paid.
On default of payment, the seller has the right to repossess the products.
No agent or employee of the seller is permitted to alter these conditions unless expressly authorised by the seller. Failure to adhere to these conditions entitles the seller to stop further deliveries.
Acceptance of the product(s) will be treated as acceptance of these conditions.
Online Payment Notice: McMullen Oils Ltd accepts payments via Laser, Visa Debit, Visa Card, and Mastercard. We regret that American Express and other unlisted cards cannot be accepted. The only online payment method is by Credit Card, except for customers with a current Direct Debit account.
